Terms of Service

1. Acceptance of Terms
By accessing or using Throb ("the App"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Throb.
2. Eligibility
You must be at least 18 years old to use Throb. By using the App, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into these Terms, and are not prohibited from using the App under any applicable law. We require date of birth verification during registration and reserve the right to use additional age verification measures. Accounts found to belong to individuals under 18 will be terminated immediately.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use of your account. Throb is not liable for any loss resulting from unauthorized account access.
4. User Conduct
You agree not to:
- Use the App for any illegal purpose
- Harass, abuse, threaten, stalk, or harm other users
- Post false, misleading, or deceptive information
- Impersonate any person or entity
- Upload content that infringes on intellectual property rights
- Upload, share, or distribute child sexual abuse material (CSAM) or any content depicting minors in a sexual manner
- Attempt to gain unauthorized access to the App or its systems
- Use automated systems, bots, or scrapers to access the App
- Solicit money or other items of value from other users
- Send false or malicious health alerts
- Screenshot, record, or redistribute another user's private album content or expiring photos without their consent
- Use the App to facilitate commercial sex work, prostitution, or human trafficking
- Distribute malware or engage in phishing through the App
We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending or terminating accounts, and reporting to law enforcement.
5. Content
Your Content: You retain ownership of content you post but grant Throb a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, and distribute your content solely in connection with operating and providing the App. This license ends when you delete your content or account, except where your content has been shared with other users or is retained as required by law.
Content Responsibility: You are solely responsible for your content and the consequences of posting or sharing it. You represent that you have all necessary rights to the content you upload and that it does not violate any third party's rights.
Prohibited Content: Content depicting minors, non-consensual acts, or any illegal activity will be removed immediately and may be reported to law enforcement. We are required by law to report CSAM to the National Center for Missing & Exploited Children (NCMEC).
Private Albums and Expiring Photos: These features provide user-controlled access to content. However, they are user interface features and not security guarantees. We cannot prevent recipients from taking screenshots, screen recordings, or otherwise capturing content. You share content at your own risk. Throb is not liable for any redistribution of content by recipients.
6. Health Alerts
The App includes a feature allowing users to send anonymous health notifications ("STI Alerts") to past connections.
- Not a Medical Service: Throb is NOT a medical service, healthcare provider, or diagnostic tool. Health alerts are user-generated notifications and are not verified, confirmed, or endorsed by Throb. Throb does not provide medical advice, diagnosis, or treatment.
- No Guarantee of Accuracy: We do not verify the accuracy, truthfulness, or legitimacy of any health alert. Users should consult a qualified healthcare professional regarding any health concerns.
- No Duty to Notify: Throb has no obligation to ensure that health alerts are sent, received, or acted upon. The health alert feature is a voluntary communication tool, not a public health notification system.
- Misuse: Sending false, malicious, or harassing health alerts is a violation of these Terms and may result in account termination.
- Anonymity: Health alerts are delivered anonymously. The identity of the sender is not disclosed to the recipient.
THROB IS NOT LIABLE FOR ANY DAMAGES, EMOTIONAL DISTRESS, OR CONSEQUENCES ARISING FROM HEALTH ALERTS, WHETHER ACCURATE OR INACCURATE, SENT OR NOT SENT, RECEIVED OR NOT RECEIVED.
7. Safety and In-Person Meetings
YOUR INTERACTIONS WITH OTHER USERS ARE ENTIRELY AT YOUR OWN RISK.
No Background Checks: THROB DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, IDENTITY VERIFICATION BEYOND BASIC REGISTRATION, SEX OFFENDER REGISTRY CHECKS, OR ANY OTHER SCREENING OF ITS USERS. We do not verify or confirm the identity, background, character, or intentions of any user.
No Responsibility for User Conduct: Throb is not responsible for the conduct of any user on or off the App. This includes, but is not limited to, any physical harm, assault, battery, emotional distress, property damage, sexually transmitted infections, pregnancy, or death that may result from interactions or meetings with other users.
Assumption of Risk: By using the App and meeting other users in person, you acknowledge and accept that there are inherent risks in meeting strangers, and you voluntarily assume all such risks. You agree to take all reasonable precautions when meeting others, including meeting in public places and informing a trusted person of your plans.
Safety Features Are Tools, Not Guarantees: Features such as meetup history, health alerts, location sharing, and profile verification are tools designed to assist you. They are not safety guarantees, and their availability does not create any duty of care or liability on the part of Throb.
8. Sensitive Profile Features
The App allows you to create optional profiles containing sensitive personal information, including sexual preferences and kink interests ("Sensitive Profiles"). By creating such content, you:
- Acknowledge that you are voluntarily providing sensitive personal information
- Consent to the processing of this data as described in our Privacy Policy
- Understand that while access is controlled through an approval system, Throb cannot guarantee that approved users will not share or disclose your information
- Accept sole responsibility for the content and accuracy of your Sensitive Profiles
- Understand that you can revoke access at any time, but information already viewed cannot be "unseen"
9. Premium Features
Some features require a paid subscription ("Throb Pro"). Subscriptions are billed through Apple's App Store and automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your device's App Store settings. Refunds are handled by Apple in accordance with their refund policies. Free trial eligibility is determined by Apple and is limited to one trial per subscription group per Apple ID.
10. Termination
We may suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately. Sections 6, 7, 11, 12, 13, 14, and 15 survive termination.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, THROB DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INCLUDING USER PROFILES, HEALTH ALERTS, COMPATIBILITY SCORES, OR VERIFICATION STATUS. WE ARE NOT RESPONSIBLE FOR ANY INTERACTIONS BETWEEN USERS, WHETHER ONLINE OR IN PERSON.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THROB, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY INTERACTIONS, COMMUNICATIONS, OR MEETINGS WITH OTHER USERS; (C) ANY HEALTH ALERTS, WHETHER SENT, RECEIVED, OR NOT; (D) ANY CONTENT POSTED OR SHARED THROUGH THE APP; (E) UNAUTHORIZED ACCESS TO YOUR DATA; OR (F) ANY OTHER MATTER RELATING TO THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO THROB IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify, defend, and hold harmless Throb, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third party's rights; (d) any content you post or share through the App; (e) your interactions with other users; or (f) any health alerts you send through the App.
14. Dispute Resolution and Arbitration
Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in the United States, and judgment on the award may be entered in any court of competent jurisdiction.
CLASS ACTION WAIVER: YOU AND THROB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to admin@throb.app within 30 days of first accepting these Terms. The notice must include your name, account information, and a clear statement that you wish to opt out of arbitration.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or via push notification at least 7 days before the changes take effect. Your continued use of the App after the effective date constitutes acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.
16. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Throb.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign these Terms without our consent. We may assign these Terms without restriction.
