1. Information We Collect

Account Information: Phone number, name, date of birth, photos, and profile details you provide during registration and while using the App.

Location Data: With your permission, we collect your precise location to show nearby users, enable map features, and power location-based services. When you share your location in a chat, your precise coordinates are transmitted to the recipient. We also store meetup history records when you log in-person meetings through the App.

Sensitive Personal Information: The App allows you to optionally provide information about your sexual preferences, kink interests, and related personal details ("Sensitive Profile Data"). This information is only shared with other users when you explicitly grant access through the App's access request system. By providing this information, you give explicit consent to its collection and processing as described in this policy.

Health-Related Information: The App includes a health alert feature that allows users to send anonymous notifications to past connections regarding potential health concerns, including sexually transmitted infections ("STI Alerts"). We process and route these alerts based on your meetup history. Throb does not verify, diagnose, or confirm any health information — all alerts are user-generated. Throb is not a medical service or healthcare provider.

User Content: Photos you upload to your profile, private albums, and expiring photo messages. Private album photos are only visible to users you explicitly grant access to. Expiring photos are designed to disappear after a set duration, but this is a user interface feature, not a security guarantee — recipients may capture or record content through screenshots, screen recordings, or other means.

Usage Data: Information about how you use the App, including interactions, preferences, compatibility settings, filter usage, and activity timestamps.

Device Information: Device type, operating system, unique identifiers, and push notification tokens for app functionality, analytics, and delivering notifications.

2. How We Use Your Information

We use your information to:

  • Provide, operate, and improve the App
  • Show you relevant profiles based on your preferences and compatibility scores
  • Enable messaging, photo sharing, and connections between users
  • Route health alerts between users based on meetup history
  • Calculate compatibility scores using your profile attributes and preference weights
  • Send push notifications about messages, access requests, health alerts, and other App activity
  • Track and display meetup history for your reference and for health alert routing
  • Ensure safety, enforce our Terms, and prevent fraud
  • Comply with legal obligations

3. Information Sharing

With Other Users: Your public profile information (photos, name, bio, basic details) is visible to other users. Kink profile data and private album content are only shared when you explicitly approve an access request. Location data is shared when you use the map feature or send a location in chat. STI health alerts are delivered anonymously — the recipient does not learn your identity from an alert.

Service Providers: We share data with trusted providers who help operate the App, including cloud hosting (Supabase), push notification delivery (Expo), payment processing (RevenueCat/Apple), and analytics services.

Legal Requirements: We may disclose information when required by law, legal process, or government request, or when we believe disclosure is necessary to protect the rights, safety, or property of Throb, our users, or others.

Safety and CSAM Reporting: We may report content that constitutes child sexual abuse material (CSAM) to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement, as required by law.

We do not sell your personal information to third parties.

4. Data Security

We implement industry-standard security measures to protect your data, including encryption in transit (TLS) and at rest, row-level security policies on our database, and secure token-based authentication. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

5. Your Rights and Choices

Profile Visibility: Control what information appears on your profile through settings, including incognito browsing and hiding online status (Pro features).

Sensitive Data Controls: You choose whether to create a kink profile and control who can view it through the access request system. You control private album access and can revoke it at any time.

Location: You can disable location access in your device settings, though this will significantly limit App functionality.

Notifications: Manage push notification preferences in App settings and device settings. By using the App, you consent to receiving push notifications, including health alerts from other users.

Account Deletion: You can delete your account at any time through App settings, which will remove your profile, messages, photos, meetup history, and other data from our active systems.

Right to Access: You may request a copy of the personal data we hold about you by contacting admin@throb.app.

Right to Deletion: You have the right to request deletion of your personal data. Account deletion through the App fulfills this right. We may retain certain data as required by law.

Right to Correction: You may update or correct your personal information at any time through your profile settings.

Data Export: You may request an export of your data by contacting admin@throb.app.

6. California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to Know: You may request the categories and specific pieces of personal information we have collected about you.
  • Right to Delete: You may request deletion of your personal information, subject to certain exceptions.
  • Right to Opt-Out of Sale: We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
  • Sensitive Personal Information: We collect sensitive personal information (precise geolocation, sexual orientation and preferences) only for the purposes of providing the App's core functionality. You may limit the use of your sensitive personal information through your profile settings.

To exercise these rights, contact admin@throb.app or use the account deletion feature in the App. We will respond to verifiable requests within 45 days.

7. European Users (GDPR)

Legal Bases for Processing: We process your data based on: (a) your consent (for location data, sensitive profile data, and health alerts), (b) performance of our contract with you (to provide the App), and (c) our legitimate interests (safety, fraud prevention, analytics).

Additional Rights: You have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. You may withdraw consent at any time without affecting the lawfulness of prior processing.

Data Transfers: Your data is processed in the United States. We rely on your explicit consent for these transfers.

To exercise your rights, contact admin@throb.app. You also have the right to lodge a complaint with your local supervisory authority.

8. Data Retention

We retain your data while your account is active. Expiring photos are automatically deleted from our servers after the set duration expires. After account deletion:

  • Your profile, photos, messages, and meetup history are deleted from active systems promptly.
  • We may retain certain information in anonymized or aggregated form for analytics.
  • We may retain data as required by law, legal proceedings, or legitimate safety purposes (e.g., records related to banned accounts).
  • Backup systems may retain copies for up to 30 days after deletion.

9. Children's Privacy

Throb is strictly for users 18 years of age and older. We do not knowingly collect information from anyone under 18. We require date of birth verification during registration and may use additional age verification measures. If we learn we have collected information from a person under 18, we will delete it promptly and terminate the associated account. If you believe a minor is using the App, please report it to admin@throb.app immediately.

10. International Users

Your information is processed and stored in the United States. By using the App, you consent to the transfer of your information to the United States, which may have different data protection laws than your country of residence.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes through the App or via push notification at least 7 days before the changes take effect. Your continued use of the App after the effective date constitutes acceptance of the updated policy.
